Tunisian President Qays Sa‘īd dismisses 57 judges and vows to reveal the names of these judges “whose names are attached to suspicions of altering the process of terrorist cases and got involved to financial and moral corruption, corrupting others and scandalous wealth”. Thus according to his words.
Tunisian President Qays Sa‘īd dismissed 57 judges, whom he had accused of corruption and collusion with people accused in terrorist cases.
In the opening of his speech on Wednesday night at the cabinet meeting, Sa‘īd heavily criticized “the signs of corruption, inefficiency, and shortcomings the judiciary suffers from”. Thus expressing a “series of accusations against certain judges, who are surrounded with suspicions of being involved in corruption and covering for corrupt people, also covering for those who are accused in terrorist cases, and collusion with the involved political or financial bodies”.
Sa‘īd underlined that “these situations are the ones, which made him take a decision of measures for the cabinet at its meeting accepting a draft connected to the revision of a legislation about the Temporal Supreme Judiciary Council”.
According to a video posted on the official account of the Presidency, the Tunisian Pre vowed to reveal the names of these judges, “who are connected to suspicions of altering the procedures of terrorist cases and being involved in financial and moral corruption, corrupting others and scandalous wealth”. Thus pointing out that “all unanimous cases are being revised, so not to wrong anyone, and to so to be investigated in the next few weeks”. Also “that it is not acceptable anymore today that justice would not prevail over the shortcomings of the judiciary”.
In this context, Sa‘īd said that “I gave a chance after chance and I gave a warning so that the judges would cleanse themselves. The state cannot be washed clean of corruption and the accesses against the law, only by completely cleansing the judiciary”. He added: “There is a deliberate lag and delay in opening all cases, even though they are ready”. Thus also confirming in the same context that “the situation cannot go on indefinitely”.
The Tunisian President talked about a judge who deliberately sabotaged opening terrorist cases, and the number of these is 6268 files. This judge is surrounded by suspicions of not being unbiased and acceding his authority, directing investigations, stepping over the measures, and threatening the judges. He is breaching his mandate as a judge. He already has a hidden disciplinary case about the shortcomings of the judiciary, which was also not looked into”.
Sa‘īd outlined “a series of breaches by these judges, including delaying exposing suspicions about terrorist cases and going against the implementation of section 23 of the penal measures at the “secret organization” case. They also failed to open penal investigations connected to security and having terrorist implications”.
He also pointed out “that one of the judges exploited his position at the economic and financial judiciary board to delay the accounting of suspects in terrorist cases and getting himself involved with protection for political and influential parties. One of these is implied in intervening in the proceeding of important cases being himself in a position of advisor to the head of the government”.

عزل الرئيس التونسي قيس سعيّد 57 قاضياً كان قد اتهمهم بالفساد والتواطؤ والتستّر على متهمين في قضايا إرهاب.
وفي كلمة افتتح بها مساء الأربعاء اجتماع مجلس الوزراء، انتقد سعيّد بشدة “مظاهر الفساد والقصور والتقصير، التي يعانيها القضاء”، موجهاً “سلسلة من الاتهامات إلى بعض القضاة، الذين تحوم حولهم شبهات الضلوع في الفساد والتستر على فاسدين، وتعطيل تتبع ذوي الشبهة في قضايا إرهابية، والتواطؤ مع جهات سياسية أو مالية نافذة”.
وشدّد سعيّد على أن “هذه الوضعية هي التي حتّمت إقرار تداول مجلس الوزراء في اجتماعه مشروعاً يتعلق بتنقيح المرسوم المرتبط بالمجلس الأعلى الموقّت للقضاء”.
وتعهد الرئيس التونسي، بحسب مقطع فيديو ورد على الصفحة الرسمية لرئاسة الجمهورية، بالكشف عن أسماء هؤلاء القضاة، “ممن تعلّقت بهم شبهات تغيير مسار قضايا إرهابية، وتورط في فساد مالي وأخلاقي وارتشاء وثراء فاحش”، مشيراً إلى أنه “جرى النظر في كل الملفات من غير مصدر، حتى لا يظلم أحد، ودُقّق فيها طوال أسابيع”، وأنه “لم يعد مقبولاً اليوم أن تغيب العدالة عن قصور العدالة
وبهذا الصدد، قال سعيّد، “لقد أعطيت الفرصة تلو الفرصة، وجرى التحذير حتى يطهّر القضاء نفسه، ولا يمكن أن أطهّر البلاد من الفساد ومن تجاوز القانون، إلا بتطهير كامل للقضاء”، وأضاف: “هناك تلكؤ وتأخير متعمّد في فتح كل الملفات، مع أنها جاهزة”، مؤكّداً في السياق نفسه، أنه “لا يمكن أن يستمرّ الوضع الى ما لا نهاية
وتحدث الرئيس التونسي عن قاضٍ تعمّد تعطيل التتبع في ملفات إرهابية، وعددها 6268 محضراً، وهذا القاضي تتعلّق به شبهات عدم الحياد وتجاوز الصلاحيات وتوجيه الأبحاث وخرق الإجراءات وتهديد القضاة، وإخلالات في أداء وظيفته كقاضٍ، وله ملف تأديبي مخفي في قصور العدالة، ولم ينظر فيه أيضاً.
وتطرّق سعيّد إلى “جملة من التجاوزات لهؤلاء القضاة، من بينها تعطيل تتبّع ذوي الشبهة في ملفات إرهابية، والتصدي لتطبيق الفصل 23 من مجلة الإجراءات الجزائية في ملف “الجهاز السري”، والامتناع عن فتح أبحاث جزائية في قضايا ذات علاقة بالأمن وتحمل صبغة إرهابية”.
وأشار أيضاً إلى “استغلال أحد القضاة صفته في القطب القضائي الاقتصادي والمالي، لتعطيل تتبع ذوي الشبهة في ملفات إرهابية، والتدخل لحماية أطراف سياسية وأصحاب نفوذ، وقد تعمد أحدهم التدخّل في مسار قضايا مهمة انطلاقاً من موقعه كمستشار برئاسة الحكومة
