The Tunisian reactions following the latest decisions of Qays Sa‘īd are ongoing, while the Speaker of the Parliament suspended in its works, Rāšīd al-Ġannūšī confirms that the Speaker’s office still expresses its absolute refusal for the suspension of the People’s Assembly.
Speaker of the Parliament suspended in its works, Rāšīd al-Ġannūšī believes that the present decision of the Tunisian President Qays Sa‘īd to hold “early parliamentary elections and have a national referendum, is unconstitutional and unlawful” calling for their erase.
In a statement today signed by the Rāšīd al-Ġannūšī it was stated that the office of the Speaker of the Parliament “expresses its full refusal about the suspension of the People’s Assembly for yet another year, and considers the procedure unconstitutional and unlawful”.
The statement considered that “any modification in the constitution must be by constitutional measures”, and that the Presidency of the Parliament, in which the “an-Nahḍa” Party has the biggest biggest fractional representation “refuses any steps in this direction, which jeopardize the constitution of 2014”.
The words of al-Ġannūšī came days after the announcement by Tunisian President Qays Sa‘īd about a set of decisions, which mean that the Parliament stays suspended, or blocked until 17 December 2022 and to organize early legislative elections in accordance with the constitution, which will be voted on in a referendum.
The statement of the Tunisian President came while presiding over a cabinet meeting, while he had expressed several times before that the present constitution is not valid anymore. The constitution of 2014 stipulated a kid system giving vast prerogatives of the President to the parliament and to the government.
Following the decision of Sa‘īd came the Tunisian reactions, as the Tunisian People’s Movement believed that the measures announced by President Qays Sa‘īd are yet just another step on the path started on 25 July, while other Tunisians refused any step jeopardizing the constitution.
Sa‘īd had said previously that the “problem” Tunisia is growing through is emanating from the constitution stipulated in 2014 and pointed out that it “has become invalid”k and also that this constitution “cannot continue to function, because it has not legality”.
Since July Tunisia witnesses a political crisis, as at that time Sa‘īd started to take extraordinary measures, including the blocking the actions of the parliament, lifting the immunity of the MPs, abolishing the Constitutional Oversight Organization of the Law, issued presidential decrees, presiding over the general representation, dismissing the government, setting up a new government to which he appointed its Prime Minister.

ردود الفعل التونسية إزاء قرارات الرئيس قيس سعيّد الأخيرة مستمرة، ورئيس البرلمان التونسي المجمَّدة أعماله، راشد الغنوشي، يؤكّد أن رئاسة المجلس تعبرّ عن رفضها المطلق تعطيلَ مجلس نواب الشعب.
اعتبر رئيس البرلمان التونسي المجمَّدة أعماله، راشد الغنوشي، أن قرار الرئيس التونسي قيس سعيّد، القاضي بإجراء “انتخابات نيابية مبكّرة واستفتاء شعبي، غير دستورية وغير قانونية”، داعياً إلى إلغائه.
وجاء في بيان موقّع من جانب رئيس البرلمان راشد الغنوشي، اليوم الخميس، أن رئاسة المجلس “تعبرّ عن رفضها المطلق لتعطيل مجلس نواب الشعب عاماً آخر، وتعتبر هذا الإجراء غير دستوري وغير قانوني”.
واعتبر البيان أن “أي تحوير في الدستور يكون عبر الإجراءات الدستورية”، وأن رئاسة المجلس، الذي كان حزب “النهضة” أكبر الكتل الممثَّلة فيه، “ترفض أي مساس بهذا التمشي الذي حدده دستور 2014”.
كلام الغنوشي جاء بعد أيام من إعلان الرئيس التونسي قيس سعيد جملةً من القرارات، تتمثّل بالإبقاء على المجلس النيابي معلَّقاً أو مجمداً إلى تاريخ الـ 17 من كانون الأول/ديسمبر 2022، وتنظيم انتخابات نيابية مبكّرة وفقاً لقانون الانتخابات الذي سيتم تنقيحه.
كلام الرئيس التونسي جاء خلال إشرافه على اجتماع مجلس الوزراء، بحيث سبق له أن اعتبر، في عدة مناسبات، أنّ الدستور الحالي لم يعد صالحاً. وأقرّ النص عام 2014، وأنشأ نظاماً مختلطاً يعطي للبرلمان والحكومة صلاحيات أوسع من رئاسة الجمهورية.
وبرزت ردود فعل تونسية متباينة إزاء قرارات سعيّد، بحيث اعتبر التيار الشعبي التونسيّ أنّ الإجراءات التي أعلنها الرئيس قيس سعيّد هي خطوةٌ أخرى متقدِّمةٌ في مسار الـ25 من تموز/ يوليو، بينما يرفض توانسة آخرون أي مساس أحادي بالدستور.
وقال سعيّد، في وقت سابق، إنّ “المشكلة” التي تمرُّ فيها تونس ناجمة عن الدستور الذي تمّ إقراره عام 2014. وأشار إلى أنّه “بات غير صالح الآن”، وأنَّ هذا الدستور “لا يمكن أن يستمرّ العمل فيه، لأن لا مشروعية له”.
وتشهد تونس، منذ شهر تموز/يوليو الماضي، أزمة سياسية، حين بدأ سعيّد اتخاذ إجراءات استثنائية، منها تجميد اختصاصات البرلمان ورفع الحصانة عن نوابه، وإلغاء هيئة مراقبة دستورية القوانين، وإصدار تشريعات بمراسيم رئاسية، وترؤسه النيابة العامة، وإقالة رئيس الحكومة، وتأليف حكومة أخرى جديدة عَيَّنَ هو رئيستها.
