The Libyan Election Committee says that Sayf al-Islām al-Qaddāfī is jot eligible to be a candidate of the presidential elections and an insightful Libyan source confirms that the reason is his conviction for committing “war crimes”.
The Libyan Election Committee said today, on Wednesday that first degree sentence that Sayf al-Islām al-Qaddāfī is not eligible to be a candidate in the presidential elections, thus according to the list sent by an official of the committee today.
The committee presented the full list of names that are considered to be eligible for the elections in waiting for the Libyan judiciary’s approval process having the final word in it, also announcing that 25 candidates were removed from the 98 who registered in the upcoming presidential elections.
The Libyan Electoral Committee Council issued ruling number 79 about removing 25 candidates not fitting the presidential elections requirement.
An insightful Libyan sou said that “the judiciary authorities took a decision to remove Sayf al-Islām, son of late Colonel Mu‘ammar al-Qaddāfī from the presidential elections pool” scheduled to be held on the upcoming December 24.
The source explained that the decision for removal came, because “of a final sentence was issued by the Libyan court to execute Sayf al-Islām (49 years old)” after he was convicted for committing “war crimes”.
It added that Sayf al-Islām “did not provide anything that would prove that this ruling would have been changed or dropped”.
At the end of 2011 an armed groups arrested Sayf al-Islām and he was taken to the city of that az-Zantān (West) and was given to the court for ruling.
In 2015 a sentence was issued against him to be “executed” by firing squad convicting him for “war crimes” during an attempt to break up the protests, which toppled the rule of his father Mu‘ammar al-Qaddāfī (1969-2011).
Internationally, the International Court of Justice centered in the Hague to hand Sayf al-Islām over to be tried for committing “crimes against humanity”.
For some 10 years Sayf al-Islām have not appeared openly , except in 2013 in a telefilms interview from his prison az-Zantān. After that he refrained from showing himself, until he appeared on 14 November as presenting his papers for candidacy in the office of the Electoral Committee in the city of Sabhā (south).
The Electoral Committee closed down the candidacy for the presidential elections on Monday. The number of candidates reached up to 98. The most prominent amongst them are the head of the current unity government ‘Abd al-Ḥamīd ad-Dabība and the retired Libyan General Halīfa Ḥaftar, who, just like Sayf al-Islām caused a popular uproar in Libyan with their candidacy.
On November 18 the Electoral Committee referred the first list containing 10 requests presented for the presidential candidacy both to the General Director and to the General Criminal and Administrative Investigation Service for Documents and Citizenship to determine the eligibility of the candidacy.
These steps were made “in accordance with Law 1 of 2021 about the election of the state president outlining his prerogatives and his qualifications, needed for the candidacy. That is that he must not be convicted by court in a final ruling in criminal case, misdemeanor in lack of honor or trustworthiness, nor to hold the citizenship of an other country at the time of the candidacy”. Thus according to the Committee.
There are still voices opposing to hold the elections in the scheduled date, but also that many refuse the elections laws, which they see that was not accepted on a legal or consensual way,

لجنة الانتخابات الليبية تقول إنّ سيف الإسلام القذافي غير مؤهل للترشح لانتخابات الرئاسة، ومصدر ليبي مطلع يؤكد أنّ السبب هو إدانته بارتكاب “جرائم حرب
قالت لجنة الانتخابات الليبية، اليوم الأربعاء، في حكمٍ أوّليّ، إنّ سيف الإسلام القذافي غير مؤهل للترشح لانتخابات الرئاسة، وذلك وفقاً لقائمة أرسلها مسؤول من اللجنة اليوم.
وأصدرت اللجنة قائمة الأسماء الكاملة التي تعتبرها مؤهلة للترشح في الانتخابات، انتظاراً لعملية طعن القضاء الليبي، صاحب القرار النهائي فيها، معلنةً أيضاً استبعاد 25 مرشحاً من 98 مسجّلين في الانتخابات الرئاسية المرتقبة.
وأصدر مجلس مفوضية الانتخابات الليبية القرار الرقم 79 بشأن استبعاد 25 مترشحاً لا تنطبق عليهم شروط الترشح للانتخابات الرئاسية.
وقال مصدر ليبي مطّلع إنّ “السلطات القضائية اتخذت قراراً باستبعاد سيف الإسلام، نجل العقيد الراحل معمر القذافي، من خوض الانتخابات الرئاسية” المقررة في الـ 24 من كانون الأول/ ديسمبر المقبل.
وأوضح المصدر أنّ قرار الاستبعاد جاء بسبب “صدور حكم نهائي من القضاء الليبي بإعدام سيف الإسلام (49 عاماً)” إثر إدانته بارتكاب “جرائم حرب”.
وأضاف أنّ سيف الإسلام “لم يقدّم ما يفيد بطلان هذا الحكم أو إسقاطه”.
ونهاية عام 2011، ألقت مجموعة مسلحة القبض على سيف الإسلام، ونُقل إلى مدينة الزنتان (غرب)، وقُدّم إلى المحاكمة أمام القضاء.
وصدر بحقه في 2015 حكم بـ”الإعدام” رمياً بالرصاص لإدانته بارتكاب “جرائم حرب”، خلال محاولة قمع احتجاجات في 2011 أسقطت حكم والده معمر القذافي (1969-2011).
ودولياً، تطالب المحكمة الجنائية الدولية، مقرّها في مدينة لاهاي بهولندا، بتسليمها سيف الإسلام لمحاكمته بتهمة ارتكاب “جرائم ضد الإنسانية”.
وخلال نحو 10 سنوات لم يظهر سيف الإسلام علناً، إلا عام 2013 في لقاء تلفزيوني من مكان سجنه في الزنتان، ثم توارى عن الأنظار حتى ظهوره في الـ 14 من تشرين الثاني/ نوفمبر الحالي وهو يقدّم أوراق ترشحه في مكتب مفوضية الانتخابات بمدينة سبها (جنوب).
وأغلقت مفوضية الانتخابات الإثنين باب الترشح للانتخابات الرئاسية، وبلغ عدد المرشحين 98، من أبرزهم رئيس حكومة الوحدة الحالية عبد الحميد الدبيبة واللواء الليبي المتقاعد خليفة حفتر، الذي أثار ترشحه هو وسيف الإسلام غضباً شعبياً في ليبيا.
وأحالت المفوضية، في الـ 18 من تشرين الثاني/ نوفمبر الحالي، قائمة أولى تضمّ طلبات 10 متقدمين من أجل الترشح للرئاسة إلى كل من النائب العام وجهاز المباحث الجنائية والإدارة العامة للجوازات والجنسية، لتحديد مدى أهليتهم للترشح.
وتأتي هذه الخطوة “عملاً بالقانون الرقم 1 لسنة 2021 بشأن انتخاب رئيس الدولة وتحديد صلاحياته، وتعديلاته، الذي يشترط على المترشح ألا يكون محكوماً عليه نهائياً في جناية أو جنحة مخلة بالشرف أو الأمانة، وأن لا يحمل جنسية دولة أخرى عند ترشحه”، وفق المفوضية.
ولا تزال هناك أصوات رافضة لإقامة الانتخابات في مواعيدها المقررة، ولا سيما في ظل رفض كثيرين القوانين الانتخابية، التي يرون أنها لم تُعتمد بصورة قانونية وتوافقية
