Royal decree decides to postpone holding the Kuwaiti parliamentary session for a week following an opposition by the MPs to form the new government and an MP refused to take the electricity portfolio.
According to government spokesman Ṭāriq al-Mazram on Saturday in Kuwait, a royal decree decrees to postpone holding the first session of the recently elected Kuwaiti National Assembly for a week.
The Kuwaiti news agency mentions that the decree to postpone the session came in light of the MPs opposing the formation of the government and MP ‘Ammār al-‘Ağamī refused to take the electricity portfolio. This was mentioned in the news agency’s Twitter account.
Al-Mazram said: “the decree to postpone holding the meeting of the National Assembly for a week instead of Tuesday, and that is based on session 106 of the constitution”.
Session 106 of the constitution stipulates that “the Emir has the prerogative to postpone the National Assembly session for a time not exceeding a month with a decree”.
Also, the Kuwaiti “ar-Ra’y” newspaper quoted Representative Ğanān Būšahrī saying that “the measures that are taken are desperate in the constitution and the democratic life and the government has to take immediate steps and has to lift the decision to postpone the parliamentary session”.
Būšahrī added that “the government hasn’t even taken its constitutional oath a decree was taken by the Emir of the country”. Thus she called on MP Aḥmad as-Sa‘dūn to “invite the MPs to hold a meeting to take a firm step in the defense of the constitution”.
On the other hand expert on the Kuwaiti constitution and former minister, Fāliḥ al-‘Azab confirmed to the same newspaper that “postponing the session of the National Assembly is considered within the constitutional rights of the country’s Emir”.
The postponement of the first parliamentary session came two days after 45 MPs out of the 50 rejected the formation of the new government.
Wednesday a royal decree was issued reappointing aš-Šayh Aḥmad Nawwāf aṣ-Ṣabāḥ to the post of Prime Minister for the second time within 73 days, and the following night, the formation of the government was approved, which government included new members at the head of the defense, health and oil portfolios.
The local media, including the Kuwaiti official news agency, claims that that government composition hasn’t been formulated and it is being studied on how to solve the primary crisis between the legislative and the executive powers that is permanent since the elections held last September and on which the opposition gained 60% of the parliamentary seats.
On 2 August a royal decree was issued to dissolve the parliament for the lack of cooperation between the legislative and the executive powers in the crisis that lasted for several months. On 28 September the Kuwaitis elected the new parliament.
The National Assembly in Kuwait holds strong influence which includes the accounting of the Prime Minister and the ministers and initiates a vote of no confidence.
On 2 October Kuwaiti Emir aš-Šayh Nawwāf al-Aḥmad al-Ğābir aṣ-Ṣabāḥ accepted the resignation of the government led by aš-Šayh Aḥmad Nawwāf al-Aḥmad aṣ-Ṣabāḥ and tasked him to act as caretaker until a new government following the announcement of the results of the parliamentary elections.

مرسوم أميري يقضي بتأجيل انعقاد البرلمان الكويتي لمدة أسبوع، في ظل رفض نيابي للتشكيلة الجديدة للحكومة، واعتذار نائب عن حقيبة الكهرباء
أفاد مرسوم أميري في الكويت، مساء السبت، بتأجيل عقد أول جلسة لمجلس الأمة الكويتي المنتخب حديثاً، لمدة أسبوع، حسب ما قال الناطق الرسمي باسم الحكومة طارق المزرم.
وذكرت وكالة الأنباء الكويتية، أن قرار تأجيل الجلسة جاء في ظل رفض نيابي لتشكيل الحكومة الجديدة، واعتذار النائب عمار العجمي عن حقيبة الكهرباء، وفق ما ذكره الأخير في حسابه في “تويتر
وقال المزرم: “صدر مرسوم بتأجيل انعقاد اجتماع مجلس الأمة إلى الأسبوع المقبل، بدلاً من يوم الثلاثاء المقبل، استناداً للمادة 106 من الدستور
وتنص المادة 106 من الدستور على صلاحية “الأمير أن يؤجل، بمرسوم، اجتماع مجلس الأمة لمدة لا تتجاوز شهراً
كذلك، نقلت صحيفة “الرأي” الكويتية المحلية، عن النائبة جنان بوشهري قولها، إنّ “ما يحدث من إجراءات يعتبر عبثاً في الدستور والحياة الديمقراطية، فلا يمكن لحكومة تصريف العاجل من الأمور، رفع مرسوم تأجيل انعقاد المجلس
وأضافت بوشهري أنه “لا يمكن لحكومة لم تؤدِّ اليمين الدستورية رفع المرسوم إلى أمير البلاد”، داعيةً النائب أحمد السعدون، إلى “دعوة النواب لاجتماع في ديوانه لاتخاذ موقف يحمي الدستور
في المقابل، أكد الخبير الدستوري الكويتي والوزير السابق فالح العزب للصحيفة نفسها، بـ”جواز تأجيل انعقاد اجتماع مجلس الأمة باعتبار ذلك من السلطات الدستورية لأمير البلاد”.
ويأتي تأجيل انعقاد أول جلسة نيابية، بعد يومين من رفض ـ45 نائباً من أصل 50 تشكيل الحكومة الجديدة.
ويوم الأربعاء، صدر مرسوم أميري بإعادة تعيين الشيخ أحمد نواف الأحمد الصباح، رئيساً للحكومة للمرة الثانية خلال 73 يوماً، ثم تلاه مساءً الموافقة على تشكيل حكومة ضمت وزراء جدد لحقائب الدفاع والصحة والنفط.
ويرجّح الإعلام المحلي، منها صحيفة “الأنباء الكويتية”، أنّ التشكيل الحكومي لم يحسم بعد، وأنّ البحث جارٍ لحل الأزمة الأولى من نوعها بين السلطتين التشريعية والتنفيذية، منذ الانتخابات التي أجريت نهاية شهر أيلول/سبتمبر الماضي، وأسفرت عن حصول المعارضة على حوالى 60% من مقاعد البرلمان.
وفي 2 آب/أغسطس الماضي، صدر مرسوم أميري بحلّ المجلس لعدم التعاون بين السلطتين التشريعية والتنفيذية في أزمة استمرت عدة أشهر. وانتخب الكويتيون برلماناً جديداً، في 28 أيلول/سبتمبر الماضي.
ويتمتع مجلس الأمة في الكويت بنفوذ قوي يخوّله استجواب رئيس الحكومة والوزراء، والتصويت على حجب الثقة.
وكان أمير الكويت الشيخ نواف الأحمد الجابر الصباح، قد قبل استقالة الحكومة برئاسة الشيخ أحمد نواف الأحمد الصباح في 2 تشرين الأول/أكتوبر الجاري، وكلفها بتصريف الأعمال لحين تشكيل حكومة جديدة، وذلك في أعقاب إعلان نتائج الانتخابات البرلمانية
