After the Iraqi federal court’s decision regarding the oil and gas legislation of Iraqi Kurdistan region being unconstitutional Iraqi President Barham Ṣāliḥ calls upon the necessity to have dialogue between the federal government and the government of Iraqi Kurdistan region in order to find a practical solution.
Iraqi President Barham Ṣāliḥ said on Thursday that “the hesitation of different political forces for more then a decade until now to decide on the oil and gas legislation contributed to the arise of problems and crises”.
Ṣāliḥ pointed out in a statement of his about the decision of the Federal Supreme Court that “the precarious political situation, which is tormenting Iraq demands all factions to take responsibility in order to get through the current crisis”. Thus calling upon the necessity to conduct serious and immediate dialogue between the federal government and the government of Iraqi Kurdistan region to find a process securing a way out with an applicable solution.
Ṣāliḥ pointed out that “all lost pieces contrite arise of an unnatural situation about handling the oil riches in Iraq, including in it the [Kurdistan] region. Thus confirming that “the relation between the federal government and that of the region must be looked over with patriotic responsibility, since that led to the citizens of Iraqi Kurdistan region to suffer hardship”.
Previously today the federal government issued an explanation about its decision finding to the oil and gas legislation in Iraqi Kurdistan region in Iraq to be unconstitutional.
According to its decision the federal government believed that the oil deals the government of Iraqi Kurdistan region cut with foreign oil companies, partners and states “are void”, and this matter extends to the exploratory, extraction, export and sell agreements, as the Oil Ministry has to verify all agreements the government of Iraqi Kurdistan signs with oil and gas companies.
Iraqi Kurdistan responded to this decision, as President Mas‘ūd Barazānī in a statement said that “the decision of the Federal Supreme Court about the oil and gas of the Kurdistan region is a simply political decision, it is counter to the federal system in Iraq, and the goal of this is to undermine Kurdistan region and the federal system in Iraq”.

برهم صالح: تردّد القوى السياسية في إقرار قانون النفط والغاز ساهم في خلق الأزمات

بعد قرار المحكمة الاتحادية العراقية بشأن عدم دستورية قانون النفط والغاز في إقليم كردستان العراق، الرئيس العراقي، برهم صالح، يدعو إلى ضرورة إطلاق حوار بين الحكومة الاتّحادية وحكومة إقليم كردستان من أجل إيجاد حلول عملية.
قال الرئيس العراقي برهم صالح، اليوم الخميس، إنّ “تردّد مختلف القوى السياسية، على امتداد أكثر من عقدٍ مضى، في إقرار قانون النفط والغاز، ساهم في خلق الإشكاليات والأزمات”.
وشدّد صالح، في بيانٍ له بشأن قرار المحكمة الاتّحادية العليا، على أن “الوضع السياسيّ الحرج الذي يجتازه العراق يتطّلب من جميع الأفرقاء التحلّي بالمسؤولية من أجل تجاوز الأزمة الراهنة”، داعياً إلى ضرورة إطلاق حوار جادٍّ وعاجلٍ بين الحكومة الاتّحادية وحكومة إقليم كردستان، لإيجاد آلياتٍ تضمن الخروج بحلولٍ عملية.
وأشار صالح إلى أن “كلّ الحلقات المفقودة ساهمت في خلق أجواءٍ غير طبيعيةٍ لإدارة الثروة النفطية في العراق، وضمنه الإقليم”، مؤكّداً انّه “يجب النظر بمسؤوليةٍ وطنيةٍ الى العلاقة بين الحكومة الاتّحادية والإقليم، والتي أدّت إلى تعرّض مواطني إقليم كردستان للمعاناة.
وفي وقت سابق اليوم، أصدرت المحكمة الاتحادية توضيحاً بشأن قرارها المتعلق بعدم دستورية قانون النفط والغاز في إقليم كردستان العراق.
ورأت المحكمة الاتحادية، بحسب قرارها، أنّ عقود النفط، التي أبرمتها حكومة إقليم كردستان العراق مع شركات نفطية وأطراف ودول أجنبية، “باطلة”. ويشمل هذا الأمر اتفاقيات الاستكشاف والاستخراج والتصدير والبيع، كما يجب السماح لوزارة النفط بالتدقيق في كل الاتفاقيات التي أبرمتها حكومة إقليم كردستان مع شركات للنفط والغاز.
وردّ إقليم كردستان على هذا القرار، بحيث قال الرئيس مسعود بارزاني، في بيان، إنّ “قرار المحكمة الاتحادية العليا بشأن نفط إقليم كردستان وغازه قرار سياسي بحت، بالضد من الدستور العراقي الفيدرالي، والهدف منه معاداة إقليم كردستان والنظام الفيدرالي في العراق
